Kanu Files Criminal Complaint Against DSS Witnesses Ahead of Judgment

Leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has lodged a direct criminal complaint against two Department of State Services (DSS) witnesses, days before judgment is expected in his terrorism trial.

The complaint, filed before a chief magistrate’s court in Abuja through his counsel, Aloy Ejimakor, accuses the witnesses—identified as TAA (PW1) and BBB (PW2)—of “willfully giving false evidence on oath” during proceedings at the Federal High Court.

Filed under the Penal Code, the Administration of Criminal Justice Act, 2015, and relevant constitutional provisions, the complaint alleges that the two prosecution witnesses committed perjury during the trial-within-trial held between May and July 2025.

According to the filing, TAA falsely denied knowledge of Mr. Brown Ekwoaba, a DSS Assistant Director alleged to have overseen Kanu’s detention and interrogation between 2015 and 2016. Kanu’s team referenced affidavits and other public records to challenge the witness’s testimony.

Similarly, BBB was said to have contradicted himself by claiming his only encounter with Kanu was in court, despite earlier stating that he conducted a video interview with the IPOB leader on July 17, 2021, at DSS headquarters.

Kanu maintains that the masked witnesses provided misleading evidence to obscure the chain of custody surrounding his statements from 2015 and 2021.

The IPOB leader, who has remained in DSS custody since 2015, is facing terrorism-related charges. He recently dismissed his legal team, insisting he would defend himself and arguing that the case against him lacks merit.

Despite the trial judge’s advice to seek counsel and enter a defence, Kanu declined, prompting Justice James Omotosho to fix November 20 for judgment.

Kanu has also submitted a separate motion seeking to halt the Federal High Court from delivering its verdict.
